Hi All,We need your help and suggestions...A friend of mine who works for TCS has been detailed by US Border Patrol here at Rochester, NY.His story goes like this..This L1B expired in Dec 2011. So, TCS filed L1B petition for him. He was here in US working on "pending petitonal approval status" for the last 6 months. Unfortunately, his L1B extension was denied a few weeks ago. Now, yesterday when he was flying back to India as his extension was denied, Border Patrol pulled him out of the queue at the airport and questioned him.According to them, he has been here illegally for the last 6 months. So they have detailed him, his wife and his kid at the Irondequit police station since yesterday. The Patrol guys asked him to sign a document that acknowledges he has been staying illegially for the last 6 months. My friend has denied to sign that doc.We think he didnt break any law. Can someone more experienced than me on this matter comment please? Any kind of guidance in this matter would be very helpful.

Hi,Its been a while this incident happened but wanted to update just i n case anyone else goes through this situation.After about 3 weeks of detention, my friend was allow to leave the country. TCS hired a lawyer who explined the laws to the border patrol. They even sent an apology email to TCS. My friend is back in India now.

Did he carry his L1 application which states he can stay in US for 240 days or response date by USCIS (basically the acknowledgement of L1 visa extension application) and the rejection letter which gives the Window within which he has to return back? If he has returned within that date, there is no reason for him to be detained. I think TCS management would have reached him immediately. I work for TCSC and I know how Rockville office works in these cases.

What is TCS management doing? Hope they responded promptly and helping this family. Leasons: Doesnt matter what visa status you have, if you plan to travel USA (in/out), dont be employed by TCS,Infosys,CTS or any MAJOR Indian IT companies.
